Copyright laws protect the entire System, including software, documentation, data mining algorithms, screen displays, and reports. You have no ownership rights in the System. You have a license to use the System as long as this agreement remains in effect.
A valid license permits you to use the System on a non-exclusive basis for business purposes as set forth in this agreement. Any output provided to third parties must include the copyright notice: "Copyright \u00a9 Optimistic / SIA Futech. All rights reserved."
You may not remove, alter, or conceal any copyright or trademark notices. All trademarks, trade names, service marks, and copyrights remain the sole property of Optimistic.
You may not: sell or reproduce the System or its output for sale; combine the System interactively with other software without license; modify, reverse engineer, decompile, or disassemble the System; permit third-party use or operate a service bureau; copy the System or accompanying materials; use the System for malicious purposes or in any unlawful manner.
Optimistic remains the sole owner of all software, analytics, and reports generated from vehicles using Optimistic.
Vehicle and route data processed through the System is governed by our Privacy Policy. We do not share account information with third parties unless explicitly permitted by you.
Users may post factually correct reviews about Optimistic. Users may not reproduce screenshots of the user interface without permission. Optimistic reserves the right to remove inappropriate content and terminate accounts for factually incorrect reviews.
Optimistic offers no assurance that use of the System under this EULA will not violate any law or regulation applicable to you. All rights not specifically granted are reserved by Optimistic / SIA Futech.
